Terms of Service

1. Rental Agreement

By renting equipment from DadCam Rentals (operated by Nightfox Films), you agree to these terms and the Rental Agreement accepted at the time of booking. The Rental Agreement governs specific policies including fees, late returns, cancellations, and equipment care.

2. Payment

Full payment is completed before any equipment ships. We accept all major credit and debit cards. By providing a payment method, you authorize us to charge for the rental, any applicable services, shipping, protection plans, and any fees incurred during the rental period.

Orders placed on the reservation-payment schedule at checkout (offered on orders booked 35 or more days before the rental start date with a post-discount pre-tax total of $150 or more) pay a $100 reservation payment at booking; the remaining balance plus applicable tax is charged automatically to the saved card 28 days before the rental start date, exactly as disclosed and accepted at checkout. The reservation payment is fully refundable until the first balance charge attempt. All other orders pay in full at checkout. 3. Equipment Care

You agree to exercise reasonable care with all rented equipment. If damage or a defect is present when you receive the equipment, notify us within 24 hours of delivery by email or phone; damage not reported within that period is presumed to have occurred during your rental. Report later equipment issues promptly so we can troubleshoot them.

4. Vintage Equipment

All equipment is rented as-is. We test and verify function before every shipment but do not guarantee uninterrupted operation. See the Rental Agreement for our equipment issue policy.

5. Protection Plans

DadGuard and DadGuard+ are contractual liability caps, not insurance policies. Section 6 of the Rental Agreement contains the controlling coverage details, exclusions, and liability caps; the DadGuard page provides a plain-language summary.

6. Shipping

We ship via ground carrier. Delivery dates are estimates, not guarantees. Use the prepaid USPS return label we provide unless we agree to a different method in writing. An unapproved shipping method may result in late fees if it delays the return.

7. Post-Production Services

Footage plans are fulfilled after the camera is returned. Turnaround times are estimates. See the Rental Agreement for full details.

8. Limitation of Liability

DadCam Rentals' total liability for any claim arising from a rental, including equipment malfunction, data loss, or missed events, is limited to a refund of the rental charges paid. We are not liable for any indirect, incidental, or consequential damages, including lost revenue, missed footage, or event costs.

9. Governing Law

These terms are governed by the laws of the State of New York. Any disputes shall be resolved in Monroe County, NY.

10. Changes

We may update these terms from time to time. Changes will be posted on this page with an updated date.
